1. Acceptance of Terms
By accessing or using Salon Evolve Assistant ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is intended for licensed beauty professionals and salon business owners.
2. Subscription & Billing
Salon Evolve Assistant is offered as a subscription-based service with the following terms:
- Billing cycle: Subscriptions are billed monthly or annually depending on the plan you select. Monthly charges renew on the same day each month.
- Free trial: New subscribers receive a 14-day free trial. Your credit card is required at signup but will not be charged until the trial period ends. You may cancel at any time before your trial ends to avoid being charged.
- Automatic renewal: Subscriptions automatically renew unless canceled before the renewal date. By providing your payment method, you authorize Salon Evolve Assistant to charge you on a recurring basis.
- Pricing: Current pricing is displayed on the pricing page and during checkout. Salon Evolve reserves the right to change pricing for new subscribers with reasonable notice.
- Taxes: Prices are exclusive of applicable taxes, which may be added at checkout depending on your location.
3. Founding Beta Pricing
Members who subscribe during the founding beta period receive a special discounted rate with the following conditions:
- Your founding beta pricing is locked in for the lifetime of your active subscription.
- If you cancel your subscription and later resubscribe, you will be charged the standard pricing in effect at that time. Founding beta rates will not be reinstated after cancellation.
- Founding beta pricing is non-transferable and applies only to the account that originally subscribed during the beta period.
4. Cancellation Policy
- You may cancel your subscription at any time from the Billing & Subscription page within the app.
- Upon cancellation, you will retain full access to the Service through the end of your current billing period. No partial refunds are issued for unused time.
- After your billing period ends, your account will be deactivated. Your data will be retained for 30 days following deactivation, after which it will be permanently deleted.
- To request a refund outside of these terms, please contact our support team within 7 days of a charge.
5. Data Retention
Your data (including salon performance metrics, client notes, financial records, and team information) is retained while your subscription is active. Following cancellation, data is retained for 30 days to allow for potential reactivation. After 30 days, all data associated with your account is permanently deleted and cannot be recovered.
6. Acceptable Use
The Service is designed for use by licensed beauty professionals including salon owners, independent stylists, bridal beauty artists, and extension specialists. By using the Service, you agree to:
- Provide accurate information when creating your account and using the Service.
- Use the Service only for lawful purposes related to your beauty business.
- Not share your account credentials or allow unauthorized access to your account.
- Not attempt to reverse-engineer, copy, or create derivative works of the Service.
- Not use the Service to store or transmit illegal, harmful, or offensive content.
7. Service Modifications
Salon Evolve reserves the right to modify, enhance, or discontinue features of the Service at any time. We will provide reasonable notice of significant changes. Pricing changes for existing subscribers will be communicated at least 30 days in advance. New features may be introduced at additional cost or as part of higher-tier plans.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied.
- Salon Evolve Assistant shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid for the Service in the 3 months preceding the claim.
- We do not guarantee that the Service will be uninterrupted, error-free, or that any business outcomes will result from use of the Service. Financial data, reports, and AI-generated insights are for informational purposes only and should not replace professional financial or legal advice.
9. Intellectual Property
All content, features, and functionality of the Service — including but not limited to the software, design, text, graphics, and AI-generated insights — are owned by Salon Evolve Assistant and are protected by intellectual property laws. You retain ownership of all data you input into the Service.
10. Governing Law
These Terms of Service are governed by the laws of the United States. Any disputes arising from these terms or your use of the Service shall be resolved through binding arbitration in accordance with applicable law.
